Magic: the Gathering Design Internship Contest

The Great Designer Search II (the "Search") consists of a skill-based contest whereby eligible entrants can compete for the opportunity to interview for a Magic: the Gathering design internship with Wizards of the Coast LLC ("Wizards"). By entering the Search, you ("you" or "contestant") agree to be bound by these Official Rules and any other requirements designated by Wizards.
Eligibility: The following eligibility requirements must be met in order to enter and participate in the Search:
- As of October 6, 2010, you must be at least eighteen (18) years of age.
- As of October 6, 2010, you must be residing in and legally eligible for long-term work in the United States for any employer. Upon request, proof of such eligibility must be provided to Wizards.
- You must be fluent in English.
- You must timely and fully complete any and all documents required by Wizards in connection with the Search, including, without limitation, when and if requested by Wizards, an employment application, an employment questionnaire, a confidentiality agreement, and a Consent and Release relating to Wizards' use of your name and likeness (in addition to the consent and release included herein).
- You must agree to be bound by and comply with all the terms and conditions set forth in these Official Rules.
- To become the Internship Winner, you must agree to, at your own expense, move and live near the Company's headquarters in Renton, Washington for the period of the Internship.
- You must already be, or agree to become as part of the entry process, a member in good standing of the Wizards community at www.community.wizards.com (the "Community"), and agree to all terms and conditions associated therewith.
- Employees of Wizards, its parent, affiliates, subsidiaries, and their immediate families (parents, children, siblings, spouse) and members of their same households (related or not) are not eligible to participate in the Search. In addition, former employees of Wizards are not eligible to participate in the Search.
How to Enter: To enter the Search, go to www.dailymtg.com (the "Site") between 12:01 a.m. EST on October 6, 2010 and 12:01 a.m. EST on October 11, 2010, click on The Great Designer Search II link, and follow the on-screen instructions to complete and submit the Round One essay test. You will be asked to enter your complete name and email address. You will also be asked to agree to these Official Rules. Failure to enter this information or agree to these Official Rules will result in your inability to participate in the Search. All materials submitted to Wizards during the Search become the property of Wizards and will not be acknowledged or returned. Limit one (1) entry per person.
How it Works, Competition Dates and Deadlines:
Round One: Round One begins at 12:01 a.m. EST on October 6, 2010 and concludes at 12:01 a.m. EST on October 11, 2010. Round One consists of an essay exam. To complete Round One you will be required to answer 10 essay questions. Answers to each essay question in Round One must be no less than 250 words and no more than 350 words in length. Contestants submitting shorter or longer answers will not continue to Round Two. The essay exam is available on the Site and all contestants are encouraged to begin working on the essay exam as soon as possible. However, exam answers may only be submitted as set forth in these Official Rules.
Contestants who successfully complete Round One shall qualify for and advance to Round Two. Wizards will notify those who have qualified by e-mail on or about October 11, 2010. This email notification will include instructions for how to participate in Round Two.
Round Two: For those who qualify, Round Two begins at 12:01 a.m. EST on October 13, 2010 and concludes at 11:59 p.m. EST on October 13, 2010. Round Two consists of a multiple choice exam that tests contestants' Magic: The Gathering knowledge as well as their familiarity with numerous elements of Magic: The Gathering important to game design. During Round Two, the multiple choice exam shall be made available only to qualifying contestants.
Advancement to Round Three will be based on the number of exam questions answered correctly. Wizards anticipates advancing approximately the top 100 contestants. However, Wizards may increase or decrease this number in its sole discretion. Wizards will notify by e-mail on or about October 14, 2010 those who have qualified for Round Three. This email notification will include instructions for how to participate in Round Three.
Round Three: Round Three will consist of an assignment to create a Magic: The Gathering "world" design. All contestants are encouraged to begin working on their "world" design as soon as possible. However, only contestants qualifying for Round Three may submit their "world" designs for the Search. For those who qualify, Round Three submissions will be accepted beginning at 12:01 a.m. EST on October 15, 2010 and ending at 11:59 p.m. EST on October 17, 2010.
One or more Wizards employees shall serve as judges to determine which contestants will advance to the Final Round. To determine who will advance to the Final Round the judges will assess (1) the contestants' essay answers from Round One, and (2) the contestants' performance in the Round Three assignment. The judges' assessment will be based: 40% on vision, 25% on creativity, 20% on knowledge of Magic: The Gathering, and 15% on originality. The judges will also take into consideration the number of Round Two exam questions answered correctly by the contestant as compared to other qualifying contestants. Round One will be rated 30%, Round Two will be weighted 10%, and Round Three will be weighted 60%. Wizards anticipates that eight (8) contestants will advance to the Final Round. However, Wizards may increase or decrease this number in its sole discretion. Wizards will notify by e-mail on or about November 3, 2010 those who may qualify for the Final Round. This email notification will include instructions for how to participate in the Final Round. Wizards will also publish on the Site the names of contestants who have qualified for the Final Round.
Final Round: For those who qualify, the Final Round will begin at 12:01 a.m. EST on November 10, 2010 and end at 11:59 p.m. EST on February 2, 2011. The finalists will be given five challenges during this period. The challenges shall be made available to the finalists and the Community simultaneously on the Community's website at 12:01 a.m. EST on the Start Date. Finalists shall work on the challenges publicly on the Community's website and will submit their results to Wizards by 11:59 p.m. EST on or before the Submission Deadline. The Final Round challenges shall be made available and due back according to the following schedule:

After each challenge is complete, a panel of Wizards employees (to include Mark Rosewater, Head Designer for Magic: The Gathering and such other Wizards employees as Wizards determines in its sole discretion) shall assess the finalists' work and one or more finalist will be cut. The judges' assessment will be based: 40% on vision, 25% on creativity, 20% on knowledge of Magic: The Gathering, and 15% on originality. Wizards hopes to have three (3) contestants survive the Final Round but reserves the right to eliminate additional, or all contestants if the judges do not find their work to be sufficient based on the foregoing criteria, or for any other reason. For each challenge Wizards shall notify the contestant who has been eliminated by email. In addition the elimination will be publicized on the Site. Contestants not eliminated in the Final Round (the "Interview Winners") will be offered an opportunity to travel to Wizards headquarters in Renton, Washington and interview for an internship position (the "Internship") within Wizards' Magic: the Gathering Research and Development Department. Interview Winners will be notified by email on January 28, 2011. This email notification will include information and instructions relating to the interview.
Interview: Wizards' standard guidelines, rules and procedures applicable to intern candidates interviewing at Wizards will apply to the Interview Winners. Requirements may include, without limitation, completion of a job application and questionnaire and execution of a confidentiality agreement. Interviews are expected to occur in February of 2011 with a successful contestant, if any, beginning the Internship on or about March 1, 2011. Wizards will pay round-trip, coach air-transportation for Interview Winners to SeaTac Airport from a major commercial airport (as determined in its sole discretion) near Interview Winners residence in the 50 United States of America or the District of Columbia, standard hotel accommodations for two (2) nights (single room), and round-trip ground transportation between SeaTac Airport and hotel, and between hotel and Wizards' headquarters. Air transportation will not be provided to any Interview Winner who lives within 100 miles of Wizards' headquarters. Any expenses not specifically mentioned in these Official Rules as being included (including, without limitation, meals, additional ground transportation, gratuities, phone usage, and other incidentals) are not included. Travel expenses to be awarded to Interview Winners will have an approximate retail value (ARV) of $700.00 (depending on the city of departure). Failure of a contestant to comply with the any term or condition of the Search, may result in forfeiture of this prize and opportunity.
Internship Details: The Internship is a six (6) month paid internship, beginning on or about March 1, 2011 and ending on or about September 1, 2011. The salary for the Internship is expected to be $3,360.00 per month, subject to adjustment in Wizards' sole discretion. Wizards hopes to offer and award the Internship to one (1) of the Interview Winners (the "Internship Winner"), however, Wizards reserves the right to not make an offer, and or to not award the Internship to anyone. In addition Wizards may, at any time, in its sole discretion and outside the scope of the Search, interview or hire additional or different individuals who have competed in the Search. All expenses incurred as a result of being hired for the Internship, including travel, relocation and housing, are the sole responsibility of the Intern. Prior to the start of the internship, the Internship Winner must complete and furnish all documents required by any governmental agency or otherwise in order for the Internship Winner to work for Wizards including, without limitation, an INS Form I-9 (Employment Eligibility and Verification Form) completed to Wizards' satisfaction. The Internship Winner must sign an Invention Assignment, Proprietary Information and Non-Solicitation Agreement in a form acceptable to Wizards. By accepting the Internship, the Internship Winner represents and warrants that his/her employment with Wizards will not violate any agreements, obligations or understandings that he/she may have with any third party or prior employer. The Internship Winner agrees not to make any unauthorized disclosure to Wizards or use on behalf of Wizards any confidential information belonging to any of his/her former employers (except in accordance with agreements between Wizards and any such former employer). Employment as an intern with Wizards is "at-will". Wizards reserves the right to terminate the Internship with or without cause, and with or without notice, at any time and in its sole discretion.
Collaboration with Community. Contestants shall be encouraged to work openly with the Community to complete the design portions of Round Three and the Final Round. All interactions with the Community shall be subject to the Community's applicable Terms of Service and Code of Conduct.
Confidentiality. Except as specifically permitted or required hereunder or under the rules relating to a particular Search round, until the deadline has passed for completion of such round, contestants may not discuss that round, including without limitation discussing any assignment or quiz on any online message boards, forums or the like.
Public Critique: Without limiting the other terms and conditions set out in these Official Terms, by entering the Search you agree that your submissions (together with your name) may be publically posted and critiqued by Wizards' on the Site, within the Community or otherwise. Further, third parties may critique your submissions in the Community or otherwise and Wizards shall have no control or responsibility in connection with such third party critiques. The Internship Winner and winners of each round (and those eliminated in the Final Round) may be identified by Wizards on the Site, within the Community or otherwise.
Search Requirements Subject to Change: Because of the unique nature and scope of this Search, and because of the complexity of the administration of this Search, Wizards reserves the right, in addition to those other rights reserved herein, to modify any dates, deadlines, or other provisions or requirements set forth in these Official Rules or otherwise governing this Search at any time without notice. To remain eligible, contestants must comply with all dates, deadlines and other requirements as determined by Wizards in its sole discretion.
General Conditions: By participating in the Search, you (i) represent and warrant that you meet all of the eligibility requirements set out in these Official Rules, and (ii) agree to be bound by these Official Rules and the decisions of Wizards and the judges. Wizards has no obligation to contestants whatsoever. Wizards may, but shall have no obligation to, notify any contestant that he or she is not advancing to the next round. Wizards is under no obligation to select contestants to participate in any portion of the Search. Wizards will not pay any money or give any other consideration to contestants for their participation in the Search except as specifically provided in these Official Rules. The Search and/or selection of a Interview Winner or an Internship Winner does not constitute Wizards' promise or guarantee (either expressed or implied) to contestants of a contract for employment or a guarantee of future employment.
Failure to comply with any portion of these Official Rules may result in disqualification. A contestant may be disqualified, at the sole discretion of Wizards, if he or she attempts to (a) enter the Search through any means other than described in these Official Rules; or (b) disrupt the Search, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the Search. Wizards reserves the right, exercisable at any time in its sole discretion, to disqualify you from the Search should you at any time supply untruthful, inaccurate, or misleading personal information or for any other reason or no reason at all. Contestants acknowledge and agree that, except for Community contributions permitted hereunder, (i), they are the sole author of any materials they submit to Wizards as part of the Search (the "Materials"), (ii) they own the copyright in and to their Materials, and (iii) the Materials do not infringe any third party rights (including without limitation, copyright, trademark, trade dress rights, or rights of privacy or publicity). By entering the Search, contestants hereby assign to Wizards all their intellectual property rights in and to any Materials. Such Materials are the property of Wizards, and upon Wizards' request, contestants agree to execute any documents necessary to effectuate such ownership including without limitation a written assignment of copyright. Contestants specifically acknowledge and agree that Wizards will have the right, without restriction, to use, reproduce, publish and distribute any Materials submitted without payment of any compensation or consideration to any contestant or any other person or entity (except the prize awarded to the Internship winner, if any, pursuant to these Official Rules) without restriction on a world-wide basis. By entering the Search, contestants agree that Wizards may post any Materials they provide to Wizards online and has the right to use such Materials along with contestant's name, city or other personal information on Wizards' website, products, services, and in any and all publicity and advertising for Wizards, including without limitation this Search or other promotions, without any attribution, notification or compensation to contestants or any other person or entity. Wizards and its agencies are not responsible for any error, omission, interruption, deletion, defect, delay in operations, theft, destruction, unauthorized access to, or alterations of, the Materials, or failure to receive any entry information, including without limitation the Materials. Further, Wizards is not responsible for late, lost, damaged, destroyed, delayed, illegible, postage-due or incomplete entries, including without limitation the Materials. Wizards reserves the right, in its sole discretion, to suspend, modify or cancel the Search at any time without notice.
BY PARTICIPATING IN THE SEARCH, CONTESTANTS AGREE TO FOREVER RELEASE, INDEMNIFY AND HOLD HARMLESS WIZARDS, ITS PARENT AND AFFILIATES AND ITS AND THEIR CURRENT AND FORMER DIRECTORS, OFFICERS, AND EMPLOYEES, FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING FROM, INCIDENTAL TO, OR IN CONNECTION WITH THE SEARCH, OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURIES, DEATH AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY, WHETHER SUFFERED BY CONTESTANT OR A THIRD PARTY. THE INTERVIEW WINNERS AND INTERNSHIP WINNER (IF ONE IS SELECTED), ON BEHALF OF HIM OR HERSELF, HIS OR HER EXECUTORS, HEIRS AND ASSIGNS, BY ACCEPTANCE OF A PRIZE, AGREES TO FOREVER RELEASE WIZARDS, ITS PARENT AND AFFILIATES, AND ITS AND THEIR CURRENT AND FORMER DIRECTORS, OFFICERS AND EMPLOYEES FROM ANY AND ALL LIABILITY, CLAIMS OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DAMAGES OR LOSSES OF ANY KIND TO PERSONS OR PROPERTY WHICH MAY BE SUSTAINED IN CONNECTION WITH THE SEARCH, ANY TRAVEL AWARD ASSOCIATED WITH THE INTERVIEW, THE INTERNSHIP, OR OTHERWISE.
This Search and these Official Rules will be governed, construed and interpreted under the laws of the State of Washington, and you agree to accept the exclusive jurisdiction in the courts of the State of Washington located in King County. Any waiver by Wizards of any provision of the Official Rules shall not be a waiver of such provision for the future. The invalidity or unenforceability of any part of the Official Rules shall in no way affect the validity or enforceability of any of the remainder of the Official Rules.
